APPLICANT REQUESTS THAT:

His records be corrected to reflect award of the Republic of 
Vietnam Gallantry Cross with Palm (RVGC w/P) (administratively 
resolved), Air Force Longevity Service Award (AFLSA) 
(administratively resolved), Air Force Outstanding Unit Award 
(AFOUA) (administratively resolved), Presidential Unit Citation 
(PUC) (administratively resolved) and the Small Arms Marksmanship 
Ribbon (SAEMR).


APPLICANT CONTENDS THAT:

These awards were never entered in his military record.

The applicant’s complete submission, with attachments, is at 
Exhibit A.


STATEMENT OF FACTS:

On 31 Mar 66, the applicant commenced his enlistment in the 
Regular Air Force.  He was honorably discharged on 9 Jan 70 and 
transferred to the Air Force Reserve on 10 Jan 70.  On 30 Mar 72, 
he was furnished an honorable discharge and on 25 Jul 74, he 
enlisted in the Arizona Air National Guard and was honorably 
discharged on 18 Aug 76.  He was credited with 4 years, 2 months 
and 13 days of active duty service.

AF Form 899, Request and Authorization for Permanent Change of 
Station – Military, provided by the applicant reflects he was on 
temporary duty (TDY) for M-16 Training.

The SAEMR is awarded to all Air Force service members who, after 
1 Jan 63, qualified as “expert” in small arms marksmanship with 
either the M-16 rifle or issued handgun.

The remaining relevant facts pertaining to this application are 
contained in the memorandum prepared by the Air Force office of 
primary responsibility (OPR), which is attached at Exhibit C.    

AIR FORCE EVALUATION:

AFPC/DPSID notes the applicant’s entitlement RVGC w/P, AFLSA, 
AFOUA, PUC, Vietnam Service Medal with four Bronze Service Stars, 
VSM w/4 BSS has been verified and his records will be 
administratively corrected to reflect these medals.  
Notwithstanding the above, there is no evidence of an error or an 
injustice relating to award of the SAEMR.  There was no evidence 
found showing the applicant qualified as an expert with the M-16 
rifle or issued hand gun.  Therefore, his request for award of the 
SAEMR should be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant 
on 11 Feb 15 for review and comment within 30 days (Exhibit D).  
As of this date, no response has been received by this office.


THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing 
law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice.  We took 
notice of the applicant’s complete submission in judging the 
merits of the case; however, we agree with the opinion and 
recommendation of the Air Force office of primary responsibility 
(OPR) and adopt its rationale as the basis for our conclusion the 
applicant has not been the victim of an error of injustice.  While 
the applicant provided a TDY order indicating he was travelling 
for M-16 training, there was no evidence submitted or located to 
verify he qualified as expert for the SAEMR with either the M-16 
or handgun.  We note the Air Force OPR has determined the 
applicant’s entitlement for the RVGC w/P, AFLSA, AFOUA, and PUC 
and will correct his records administratively.  Therefore, we find 
no basis to recommend granting relief beyond that rendered 
administratively.


THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not 
demonstrate the existence of material error or injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of newly 
discovered relevant evidence not considered with this application.
